Effective November 1, 2026
These Terms of Service (“Terms”) are a binding agreement between you and Blackwing Bio LLC, a Wyoming limited liability company doing business as The Three Aminos (“The Three Aminos”, “we”, “us” or “our”). They govern your access to and use of thethreeaminos.com and any related pages (the “Site”) and every purchase you make from us. Our Research Use Only Policy, Privacy Policy, Shipping Policy and Refund & Returns Policy are part of these Terms. If these Terms conflict with one of those policies, these Terms control.
Please read Section 20 carefully. It requires most disputes to be resolved by binding individual arbitration, waives class actions and jury trials, and explains how to opt out.
1. Accepting these Terms
You accept these Terms when you create an account, check the agreement box at sign-up or sign-in, or place an order. If you do not agree, do not use the Site or buy from us. If you use the Site or buy on behalf of an organization, you represent that you are authorized to bind that organization, and “you” includes it.
2. Eligibility and accounts
To create an account or purchase you must: (a) be at least 21 years old; (b) be located in the United States and ship only to a U.S. address; (c) be purchasing for legitimate laboratory research; and (d) not be barred from receiving our products under any law. You must provide accurate, complete and current account, researcher and shipping information, and you may not create more than one account or use another person’s account.
You are responsible for all activity under your account and for keeping your password confidential. Tell us immediately at contact@thethreeaminos.com if you believe your account has been compromised.
We may, at any time and before or after accepting an order, ask you to verify your identity, age, research purpose or institutional affiliation. We may decline, cancel, suspend or close any account or order, at our sole discretion, if you do not respond, if we believe any information is inaccurate, or if we believe a purchase may not be for lawful research use.
3. Research use only
All products are sold strictly for in vitro laboratory research. They are not drugs, dietary supplements, cosmetics, foods or medical devices; they have not been evaluated or approved by the U.S. Food and Drug Administration; and they are not intended to diagnose, treat, cure, mitigate or prevent any disease. Products are not for human or animal consumption or use of any kind.
We do not provide, and our staff will not answer questions about, dosing, administration, preparation for use in humans or animals, or any medical guidance. Any request for that information, or any statement (on the Site, by email, in an order note, on social media or elsewhere) that a product is or will be used in or on humans or animals, violates these Terms and our Research Use Only Policy and may result in cancellation of open orders and a permanent ban from future purchases.
The full requirements are in our Research Use Only Policy.
4. Your representations and warranties
Each time you sign in or place an order, you represent and warrant that:
- you are at least 21 years old and all information you have given us is true and complete;
- you are a qualified researcher, or are purchasing for one, with the training, facilities and equipment to handle research chemicals safely;
- you will use products only for lawful in vitro laboratory research and never in or on humans or animals, in food, drink or cosmetics, or in compounding or clinical use;
- you will not resell, distribute, repackage or relabel products, or provide them to any person, except to qualified researchers for the same research use and in compliance with these Terms and all applicable laws;
- you will not export products from the United States; and
- you will comply with all federal, state and local laws and regulations that apply to your purchase, possession, use, storage and disposal of products.
5. Assumption of risk
Research compounds may be hazardous and their properties may not be fully characterized. You assume all risks associated with the purchase, receipt, handling, storage, use and disposal of products, including any use contrary to these Terms. You are solely responsible for determining whether a product is suitable for your research and for following appropriate safety practices.
6. Product information and Certificates of Analysis
Product pages show the identity, purity and test date reported by an independent laboratory for the lot or reference batch listed, together with a Certificate of Analysis (COA) where available. COA results describe the samples tested. Chemical identifiers (such as CAS number, molecular formula and molecular weight) are provided for reference. Product photographs are illustrative; packaging and labels may vary. We make reasonable efforts to keep listings accurate but do not warrant that every description, image or price is complete, current or error-free.
7. Orders and acceptance
Your order is an offer to buy. An order confirmation email confirms only that we received your order; we accept your order when we ship it. We may refuse, limit or cancel any order or quantity, including for suspected fraud or misuse, research-use concerns, failure to complete verification, stock availability, legal or regulatory reasons, or pricing or listing errors. If we cancel an order after you have paid, we refund the amount charged, except that orders canceled for violating these Terms or our Research Use Only Policy are refunded less any non-refundable payment processing fees, to the extent permitted by law.
8. Pricing, promotions, taxes and payment
Prices are in U.S. dollars and may change at any time before you order. The total shown at checkout, including shipping and any applicable tax, is what you pay. If a product is listed at an incorrect price, we may cancel the order even after it is confirmed.
Pack pricing applies automatically by quantity and combines with promotional codes; a code’s percentage is applied to the pack price. Only one promotional code can be used per order. Promotional codes have no cash value, are non-transferable, may be limited to eligible accounts (for example, accounts created before a stated date) and to one use per customer, and may be modified or withdrawn at any time. We may cancel orders that use codes obtained or applied in violation of these rules, including through multiple accounts.
Shipping protection is optional and is added only if you select it at checkout. You authorize us and our payment processors to charge your payment method for the order total, and you represent that you are authorized to use that payment method. Orders may be screened for fraud. We do not store full payment card numbers; payments are handled by third-party processors under their own terms.
9. Shipping, title and risk of loss
We ship within the United States only. We aim to ship within the time stated in our Shipping Policy. If we cannot ship within that time, or within 30 days if no time is stated, we will notify you and offer you the choice of a full refund. You are responsible for providing a complete and accurate shipping address. Title and risk of loss pass to you when the carrier marks the package delivered to the address you provided, except as covered by shipping protection if you purchased it. Delivery dates are estimates; we are not responsible for carrier delays. Packages returned to us as undeliverable or unclaimed may be refunded less original shipping charges, or reshipped at your cost.
10. Cancellations, returns and refunds
You may cancel an order for a full refund before it ships. Because of the nature of research compounds, we cannot accept returns of shipped products. Damaged, incorrect or missing items are replaced or refunded as described in our Refund & Returns Policy.
11. Chargebacks
Please contact us before disputing a charge so we can resolve the issue. If you dispute a charge for an order that was delivered as shown by carrier tracking, we may provide your order details, delivery confirmation, account activity and your acceptance of these Terms to your card issuer and payment processor, and we may suspend your account while the dispute is open. Disputes we reasonably determine to be unfounded may result in account closure.
12. Limited warranty and disclaimer
We warrant that, when shipped, each product matches the identity on its label and meets the purity specification shown on its product page or COA. If a product does not, notify us within 30 days of delivery. As your sole and exclusive remedy, and our sole obligation, we will replace the product or refund the price you paid for it. This warranty does not apply to products that were mishandled, improperly stored after delivery, altered, or used contrary to these Terms.
EXCEPT FOR THE LIMITED WARRANTY ABOVE, AND TO THE FULLEST EXTENT PERMITTED BY LAW, PRODUCTS AND THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE”, AND WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. We do not warrant any result of research using our products, or that the Site will be uninterrupted, secure or error-free.
13. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW: (A) WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR RESEARCH RESULTS, ARISING FROM OR RELATED TO THE SITE, ANY PRODUCT OR THESE TERMS, EVEN IF ADVISED OF THEIR POSSIBILITY; AND (B) OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO ANY ORDER OR PRODUCT IS LIMITED TO THE AMOUNT YOU PAID FOR THAT ORDER. These limits apply to every theory of liability (contract, tort including negligence, strict liability or otherwise) and are an essential basis of our prices. Some states do not allow certain limitations, so some of them may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
14. Indemnity
To the fullest extent permitted by law, you agree to defend, indemnify and hold harmless Blackwing Bio LLC and its members, managers, employees, contractors and agents from and against all claims, damages, losses, liabilities, penalties and expenses (including reasonable attorneys’ fees) arising from: (a) your purchase, handling, use, storage, resale or disposal of any product; (b) any use of a product in or on humans or animals; (c) your violation of any law or third-party right; or (d) your breach of these Terms or any inaccurate information you provided. We may assume the exclusive defense of any matter subject to indemnification, and you will cooperate with that defense.
15. Acceptable use of the Site
You may not: use the Site for any unlawful purpose; scrape, harvest or copy Site content or pricing by automated means; interfere with or attempt to bypass the Site’s security, access controls or verification steps; create accounts with false information or on behalf of others without authority; post or send content that is unlawful, misleading or that promotes human or animal use of our products; or use the Site to compete with us. We may monitor use of the Site to enforce these Terms.
16. Intellectual property and feedback
The Site and its content, including text, graphics, logos, trademarks, product photographs, COA library layout and software, are owned by or licensed to us and protected by copyright, trademark and other laws. We grant you a limited, revocable, non-transferable license to view the Site for personal research purchasing. You may not copy, modify, distribute or use it for commercial purposes without our written permission. If you send us suggestions or feedback, we may use them without obligation to you.
17. Electronic communications
You agree to receive agreements, notices, order confirmations and other communications from us electronically, by email or on the Site, and that these satisfy any requirement that they be in writing. Transactional emails about your account and orders are part of the service; you may unsubscribe from promotional emails at any time.
18. Third-party sites and services
The Site may link to or rely on third-party sites and services (such as payment processors, carriers, testing laboratories and sign-in providers). We are not responsible for their content, availability or practices, and your use of them is subject to their terms.
19. Suspension, termination and compliance
We may suspend or terminate your access to the Site or your account at any time, with or without notice, including if we believe you have violated these Terms. We may cooperate with law enforcement and regulators, may disclose information as required by law or valid legal process, and may cancel orders or change our product offerings to comply with law or regulatory guidance. Sections 3 through 5, 11 through 14, 16, 20, 21 and 23 survive termination.
20. Disputes: informal resolution, arbitration and class action waiver
Informal resolution. Before starting any formal proceeding, you and we agree to try to resolve any dispute informally for at least 30 days after one party sends the other a written notice describing the dispute and the relief requested (notices to us go to contact@thethreeaminos.com). Any deadline for filing a claim is paused while this process is under way.
Binding arbitration. Any dispute, claim or controversy arising out of or relating to these Terms, the Site, any product or your relationship with us that is not resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules (or, for purchases made for an organization, its Commercial Arbitration Rules), rather than in court. The arbitrator, and not any court, decides all questions about the scope, validity, enforceability and arbitrability of this Section, except as stated under “Class action waiver” below. The Federal Arbitration Act governs this Section.
Exceptions. Either party may bring an individual claim in small claims court if it qualifies, and either party may seek an injunction in court to stop infringement or misuse of its intellectual property.
Location and costs. The arbitration may be conducted by video conference, on written submissions, or in person in the county where you live. Payment of AAA filing, administration and arbitrator fees is governed by the AAA rules, under which we pay the fees above your consumer filing fee. Each party bears its own attorneys’ fees unless the arbitrator awards them under applicable law.
Mass filings. If 25 or more similar demands are filed against us by or with the help of the same or coordinated counsel, they will be administered in batches of up to 25 demands, with one arbitrator per batch, and the AAA’s mass arbitration supplementary rules will apply. Both parties agree to cooperate in good faith to resolve batched claims efficiently.
Class action and jury trial waiver. You and we may bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated or representative proceeding. The arbitrator may award relief only on an individual basis. YOU AND WE EACH WAIVE THE RIGHT TO A JURY TRIAL. If this class action waiver is found unenforceable as to any claim or remedy (including a request for public injunctive relief), that claim or remedy will be decided by a court, after all individual arbitrable claims are resolved, and not in arbitration; the rest of this Section still applies.
Opt out. You may opt out of this Section 20 by emailing contact@thethreeaminos.com within 30 days after you first accept these Terms, stating your name, account email and that you opt out of arbitration. Opting out does not affect any other part of these Terms.
Changes. If we change this Section 20, you may reject the change by emailing us within 30 days after it is posted, in which case the prior version continues to apply to you.
21. Governing law and venue
These Terms and any dispute between you and us are governed by the laws of the State of Wyoming and applicable U.S. federal law, without regard to conflict-of-law rules. This does not remove any protection you have under the non-waivable consumer protection laws of the state where you live. Subject to Section 20, any court proceeding will be brought exclusively in the state or federal courts located in the State of Wyoming, and you and we consent to their personal jurisdiction, except that a consumer may also bring an individual claim in the courts of the county where he or she lives where applicable law guarantees that right. To the extent permitted by law, any claim must be brought within one year after it arises.
22. Changes to these Terms
We may update these Terms from time to time. The effective date above shows the latest version. Changes apply to orders placed and Site use after they are posted. If a change is material, we will notify account holders by email or on the Site, and you may need to accept the updated Terms at your next sign-in.
23. General
These Terms and the policies they reference are the entire agreement between you and us about the Site and your purchases, and they supersede any prior communications. If any provision is found unenforceable, it will be enforced to the maximum extent permitted and the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign or transfer these Terms without our written consent; we may assign them in connection with a merger, sale or reorganization of our business. We are not responsible for any delay or failure caused by events beyond our reasonable control, including carrier or supply disruptions, natural disasters, government action or internet outages. Nothing in these Terms creates a partnership, agency, fiduciary or employment relationship. Headings are for convenience only, and “including” means “including without limitation”.
24. State-specific notices
